This Copyright / DMCA Policy forms part of the Agreement and establishes Clarista’s process for handling claims of copyright infringement concerning content hosted through the Hosting Services, consistent with the Digital Millennium Copyright Act, 17 U.S.C. § 512 (the “DMCA”).

  1. Designated agent. Notifications of claimed copyright infringement should be sent to Clarista’s designated agent: Suvrat Bansal, Clarista, Inc., 20 McGuire Ct, Ridgewood, NJ 07450, USA; email: legal@clarista.io. Clarista’s designated agent is registered with the U.S. Copyright Office.

  2. Notice of infringement. A valid notice must include: (a) a physical or electronic signature of the rights owner or authorized agent; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the allegedly infringing material and information reasonably sufficient to locate it (such as the URL of the Customer Application); (d) the complainant’s contact information; (e) a statement of good-faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that the information is accurate and the complainant is authorized to act.

  3. Removal, counter-notice, and repeat infringers.

    1. Removal. Upon receipt of a valid notice, Clarista may expeditiously remove or disable access to the identified material and will take reasonable steps to notify the affected Customer.

    2. Counter-notice. The affected Customer may submit a counter-notice meeting the requirements of 17 U.S.C. § 512(g). If a valid counter-notice is received, Clarista may restore the material in 10 to 14 business days unless the complainant notifies Clarista that it has filed a court action seeking to restrain the allegedly infringing activity.

    3. Repeat infringers. Clarista maintains a policy of terminating, in appropriate circumstances, the accounts of Customers or Authorized Users who are repeat infringers.

  4. Interaction with the Agreement. Action taken under this Policy is deemed permitted takedown under Section 11 of the Hosting Schedule, and resulting unavailability is Excluded Downtime.
